What we learn about you when you order, why we keep it, and how to make us stop.
Who is responsible

What we collect
Only what an order needs: your name, the items you chose, your preferred date, your delivery area and any note you add, either your email or your WhatsApp number depending on how you asked us to reply, and — if the order contains Champagne — your confirmation that you are over 18.
The exact address is not asked for on the form. You give it to us when we confirm, in whichever channel you chose.
We do not ask for card details. There is nothing to steal from us, because we take no payment online.
Why, and on what legal basis
To take and deliver your order — performance of a contract with you, art. 6(1)(b) GDPR.
To issue an invoice and keep accounts — legal obligation, art. 6(1)(c).
Advertising and measurement cookies — your consent, art. 6(1)(a), given on the cookie banner and withdrawable at any time.
We do not build profiles, we do not make automated decisions about you, and we do not sell anything to anybody.
Who else sees it
Netlify — hosts the site and receives the order form. The United States.
WhatsApp / Meta — if you choose to order or confirm on WhatsApp, that conversation lives on their service under their terms.
Google — advertising and product listings. Google receives no name or address from us; with your consent it receives a cookie identifier that tells it an advertisement led to an order.
Meta (Facebook, Instagram) — advertising. Meta receives no name or address from us; with your consent it receives a cookie identifier that tells it an advertisement led to a message or an order.
Transfers outside the EU rely on the European Commission’s standard contractual clauses or on an adequacy decision.
How long we keep it
Order correspondence: three years, so we can answer a question about a past delivery.
Invoices and accounting records: as long as tax law requires.
Cookie consent: until you change it.
Do you have to give us this
Giving us your name, contact and delivery address is a contractual requirement: without them we cannot take an order or bring anything to you. If you would rather not, you are welcome to call or simply collect at Puerto Banús.
Everything else is optional. Cookie consent is never required — refusing it changes nothing about the service you get.
Withdrawing consent
Where we rely on your consent — that is, only for advertising cookies — you can withdraw it at any time from the cookie policy page, and withdrawal is as easy as giving it. Doing so does not affect anything that happened before you withdrew.
Your rights
You can ask us for a copy of your data, ask us to correct it, delete it, restrict what we do with it, or object to it. Write to hello@theoystersclub.nl and we will answer within one month.
If you are not satisfied you can complain to the data protection authority where we are established, or to the one where you live — in Spain that is the Agencia Española de Protección de Datos (aepd.es).
