Returns and acceptance

Fresh shellfish is not an ordinary product, and an event booked for one evening is not an ordinary purchase. This page is worth two minutes.
Right of withdrawal
Fresh oysters, caviar and other perishable goods are not covered by the fourteen-day right of withdrawal. This follows from article 103 of Royal Legislative Decree 1/2007: goods liable to deteriorate or expire rapidly, and sealed goods that are not suitable for return once opened for reasons of hygiene.
We tell you this before you order, as that article requires.
Catering and event services
An oyster station, our team shucking at your party, hostesses passing trays — these are services, not goods, and a different rule governs them.
Where a booking is for a specific date or period, the fourteen-day right of withdrawal does not apply either. This follows from article 103(l) of Royal Legislative Decree 1/2007, which covers catering and leisure services tied to a fixed date. A date reserved for you is a date we cannot sell to anyone else.
Because every event differs in size, staff and notice, cancellation terms are agreed with you in writing when we confirm the booking, before anything is due. If we are the ones who cannot perform, you get everything back.
Written confirmation
After you order we send you a confirmation you can keep — by email, or as a message you can save if you chose WhatsApp. It states what you ordered, the price, the delivery or event date and how to reach us.
Payment
We do not take prepayment. You pay on delivery or at pickup.
For varieties ordered specially from the producer, terms are agreed with you individually before we confirm.
Cancelling an order
You can cancel, and there is no cancellation fee.
Tell us as early as you can. Until we confirm your order, nothing has been set aside and there is nothing to discuss. After we confirm, the goods are allocated to you at the farm in France, so the earlier you say, the more likely we can move them to another customer rather than lose them.
If we have already bought a variety in specially for you and cannot place it elsewhere, we will say so and agree what is fair with you before anything is due. We will not charge you a penalty you did not agree to.
Acceptance
Oysters arrive in the producer’s sealed packaging. The farm packing date is printed on every box. Shelf life is twelve days from that date when kept correctly.
Check at the moment of handover: the seal is intact, the date is legible, the shells are closed. A live oyster is shut, or closes when you tap it.
If something is wrong, say so there and then and we replace it on the spot. If we have no replacement, you do not pay.
After handover
From that point storage is in your hands.
Keep the oysters in the fridge at 4–6 °C, flat side up, under a damp cloth. Not in water, not in a sealed bag, not in the freezer. In fresh water or without air they die within about an hour, and that is not a defect of the product.
What we guarantee
Unopened factory packaging with the farm packing date, product alive and conforming at the moment of handover, and the stated origin — Maison GEAY, IGP Marennes-Oléron.
Your statutory rights regarding goods that were already non-conforming when handed to you are not affected by anything on this page, and we do not seek to limit them.
